How we collect, use and protect your personal data.

This Privacy Policy is an integral part of the General Terms and Conditions published on the website with domain www.mototripbg.com, referred to as the "General Terms and Conditions"

In order to apply the personal data protection rules in force in the EU pursuant to the General Data Protection Regulation (EU) 2016/679 ("the Regulation" or "GDPR"), MotoTrip Ltd. protects the personal data you provide on the website and provides the means to manage your data and your consent to its processing. In order to comply with the requirements of the applicable personal data protection legislation, the company responsible for the protection of your personal data, in its capacity as data controller, is MotoTrip Ltd., UIC 205893397, a limited liability company registered with the Commercial Register of the Registry Agency of the Republic of Bulgaria, with registered office and management address at: Sofia, Krasno Selo district, Hipodruma residential complex, bl. 128, entrance B, floor 3, apt. 34;

MotoTrip Ltd. is the data controller for the data it processes in connection with the management of the website with domain www.mototripbg.com, as well as the provision of the Services, namely the data of its Users and their companions, and all other third parties who do not fall within the above two categories but whose data is processed through the website;

The provision of data on your part is in connection with the conclusion of a motor vehicle rental agreement, in accordance with the General Terms and Conditions.

MotoTrip Ltd. has taken the necessary technical and organizational measures to restrict unauthorized access to the personal data provided by you, as required under the GDPR, which has been in force since 25.05.2018, and makes all reasonable efforts to guarantee the inviolability of the information containing personal data provided by Users.

5. What data do we process?

a. profile-related data: names, age, address, email address, gender;

b. data from your identity documents and the documents certifying your legal capacity to drive a motor vehicle, specified in the General Terms and Conditions;

c. information necessary for making payment, including bank card numbers and bank account numbers;

  1. We collect and process the above-mentioned personal data for the following purposes and on the following legal grounds:

a. For the conclusion of a motor vehicle rental agreement, in accordance with the General Terms and Conditions;

b. for processing the payments made by you for the requested services;

c. to notify you of changes in functionality, as well as the addition of new features that may be useful to you;

d. for direct marketing purposes, as well as for the development of new products;

e. for the accounting records and taxation of our business (within the meaning of Art. 6(1)(c) of the GDPR).

f. in connection with any legal services that may be necessary in relation to the Services;

g. for providing data to the traffic police authorities and other government institutions in the cases specified in the General Terms and Conditions.

We process your personal data for the purposes stated above on the basis of your consent, as you voluntarily use the website and/or the motor vehicle rental Services, providing the data necessary for this purpose. Your explicit consent is also the basis for processing the special categories of data that we process, namely – the conclusion of a motor vehicle rental agreement.

Manner and periods of data storage:

a. Personal data information with us is collected and stored electronically on a server and on the computers of our functional departments. All personal data that we process is processed in Bulgaria, but for hosting and maintenance purposes this information may also be located on the servers and sites of data processors with whom we have a contract, including outside Bulgaria, within the EU and the USA. Third parties do not have access to your personal data, except where required by law. The data you provide is also stored on paper, in compliance with the protection measures set out in the GDPR.

b. MotoTrip Ltd. has taken the necessary technical and organizational measures to ensure the protection and confidentiality of personal data.

c. We keep your personal data only to the extent and for as long as necessary for the respective activity for which it was provided, for the provision of the Services and all rights and obligations of the parties related thereto, as well as to the extent required under the requirements and periods provided for in the applicable legislation of the Republic of Bulgaria.

d. The data you have provided for use for marketing purposes is kept until you notify us that you no longer wish to receive the relevant information from us.

e. The storage of personal data continues for as long as we have grounds for its storage – a legal requirement, consent, performance of contractual obligations. Once the purposes of the processing of your personal data have been achieved, we destroy it.

  1. As a data subject, you have the following rights:

a. the right of access to your personal data processed by MotoTrip Ltd. through www.mototripbg.com;

b. the right to rectification of inaccurate or incomplete personal data;

c. the right to request erasure of the data (the "right to be forgotten") of personal data that is processed unlawfully or on the basis of a legal ground that no longer applies (expired storage period, withdrawn consent where processed solely on the basis of the data subject's consent, fulfillment of the original purpose for which it was collected, and others);

d. the right to restriction of processing where there is a legal dispute between MotoTrip Ltd. and the data subject, until its resolution and/or for the establishment, exercise, or defense of legal claims;

e. the right to receive your personal data in a structured, commonly used, and machine-readable format and to request the transfer of this data to another controller, where this is technically feasible;

d. the right to object to the processing of your personal data for direct marketing purposes, as well as to object at any time on grounds relating to your particular situation as a data subject, provided that there are no compelling legitimate grounds for the processing which override the interests, rights, and freedoms of the data subject, or for legal proceedings;

e. the right of the data subject not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning him or her or similarly significantly affects him or her;

f. the right to lodge a complaint with the Commission for Personal Data Protection or the court.

9.1. You may exercise the above-mentioned rights, as well as all rights granted under the GDPR, by means of a written or electronic request to MotoTrip Ltd. The request should state your name, address, and other details for identifying you as a data subject, describe what your request consists of, your preferred form of communication, and the actions requested. It is necessary to sign your request and to indicate the date of submission and the address for correspondence with you.

MotoTrip Ltd. does not apply automated individual decision-making, including profiling.

Disclosure of your data to third parties. MotoTrip Ltd. discloses your personal data only in the following cases:

a. only to government authorities, institutions, and persons to whom we are obliged to provide personal data by virtue of law;

b. to the employees of MotoTrip Ltd. by granting access to the user's profile, solely and exclusively for the purpose of providing the requested Services.

  1. Protection measures

MotoTrip Ltd. collects, processes, and stores personal data in compliance with all legal requirements and by applying adequate technical and organizational security measures. In order to ensure maximum security in the processing, transfer, and storage of personal data, we also use, where necessary, additional protection mechanisms such as encryption via specialized encryption devices.

  1. Significance of the personal data provided.

We process your personal data with your consent when you voluntarily decide to receive information and offers from us. You have the right to withdraw your consent at any time, which may result in the discontinuation of the provision of services by MotoTrip Ltd. Please note that even if you exercise your right to withdraw the consent given, we will continue to store and process the personal data provided if this is necessary for the purpose of fulfilling a legal obligation.

By accepting these terms, you give your explicit consent that the personal data provided, relating to you, be processed and stored for the reasons and in the manner described.

MotoTrip Ltd. does not require Users of www.mototripbg.com to provide personal data revealing: racial or ethnic origin, political, religious, or philosophical beliefs, membership in political parties or organizations, associations with religious, philosophical, political, or trade-union aims, or data concerning health, sex life, or the human genome. The publication by a user of www.mototripbg.com, in any form, on the website www.mototripbg.com, of information, messages, comments, and any other statements containing and revealing his/her own and/or others' personal data relating to: racial or ethnic origin; political, religious, or philosophical beliefs, membership in political parties or organizations, associations with religious, philosophical, political, or trade-union aims, health, sex life, or the human genome, is a voluntary act performed at the will of the user, and MotoTrip Ltd. shall bear no liability for such actions. By publishing such information on www.mototripbg.com, the User expresses his/her explicit consent that the personal data published by him/her be disclosed to the other Users of the www.mototripbg.com platform, and shall bear full responsibility for the publication of any data to which MotoTrip Ltd. has no access or which does not originate from its administrators.

MotoTrip Ltd. has the right to amend this Privacy Policy at any time without prior notice, and Users will be notified of such changes upon each subsequent visit to the website www.mototripbg.com.
